URUGUAY – PUBLIC CONSULTATION

Geographical Indications and Appellations of Origin
DEADLINE: AUGUST 19, 2023

The Uruguayan Trademark and Patent Office (“DNPI”) has just announced the call to Public Consultation on the Draft Executive Regulation of the Registries of Geographical Indications and Appellations of Origin set forth by Uruguayan Trademark Law No. 17.011, and which function within the DNPI.

 The Draft Executive Regulation, if approved, will be a binding regulation issued by the Executive Branch, which will regulate various aspects of the operation of the above-mentioned registries and the legal regime applicable to Geographical Indications and Appellations of Origin in Uruguay.

The Draft Executive Regulation sets forth rules, among other, on the following issues:

i. Legal standing to file registrations.
ii. Formalities of the application.
iii. Necessary Documents.
iv. Oppositions to GIs and AOs registrations.
v. Annulment of GIs and AOs registrations.
vi. Cancellation of GIs and AOs registrations.
vii. Term and scope of protection.
viii. Name similarities in GIs and AOs.
ix. Conflict between GIs and AOs and Trademark Registrations.
x. Code of Use.
xi. Use and non-discrimination.
xii. Situations of prior users of GIs and AOs.

 

The Public Consultation is open for a 30-day term, until Saturday August 19, 2023.

The purpose of the consultation is to receive comments, opinions, analysis, requests, proposals, objections and remarks on said Draft Regulation on Registration of Geographical Indications and Appellations of Origin.

The consultation is open to public and private institutions, and at large to the members of the society.
